The Copyright Problem

Generative AI models are trained on vast datasets scraped from the internet — text, images, code, and audio created by humans who had no knowledge their work would be used to train AI systems. Courts in the US and EU are actively deciding whether training AI on copyrighted content constitutes infringement. Several major lawsuits are working through the courts including actions by news publishers, artists, and authors against AI companies. Artists have argued that image generation models can produce outputs in their distinctive styles without attribution or compensation. The opt-out systems some AI companies have implemented have been widely criticized as shifting the burden onto creators who never consented to inclusion in the first place.

Bias and Fairness

AI models learn patterns from their training data. When that data reflects the historical biases of the world the models reproduce and can amplify those biases. The most well-documented bias issues include gender and racial stereotypes in image generation, differential quality across languages and dialects since models trained on predominantly English internet data perform significantly worse in other languages, and socioeconomic blindspots. These biases have real consequences. AI-generated hiring materials that contain gender bias disadvantage qualified candidates. AI-assisted medical diagnosis tools that perform better for populations well-represented in training data can worsen health disparities.

Transparency and Disclosure

When content is generated by AI, audiences have a right to know in many contexts. In journalism the ethical consensus is clearly yes — AI-generated or AI-assisted articles should be disclosed. Major news organizations have published explicit policies on AI use that require labeling. The EU AI Act requires disclosure when consumers interact with AI systems in high-risk contexts. In creative work the question is more contested. If a novelist uses AI to generate draft paragraphs they then revise and integrate, is that materially different from using a thesaurus? But if AI generates most of an original work submitted for publication or entered in a competition that raises serious questions of authenticity.

Misinformation and Synthetic Media

Generative AI’s ability to produce realistic text, images, audio, and video creates serious risks for information integrity. The Coalition for Content Provenance and Authenticity has developed an open technical standard for attaching cryptographically signed metadata to media, allowing verification of its origin and history. Google, Adobe, Microsoft, and other major players have adopted this standard.

Toward Responsible AI Use

Be honest about AI involvement in your work and products. Understand the known biases of the AI systems you deploy and audit their outputs for fairness. Take seriously the potential for your AI applications to cause harm and invest in evaluation and mitigation. The organizations and individuals that engage seriously with these ethical dimensions will build more trustworthy products and navigate the coming wave of AI regulation more successfully than those who treat ethics as a constraint to be minimized.
